Terms & Conditions

The platform www.jhatfat.com, along with any associated websites or mobile applications (the "Platform"), is owned and maintained by AVW India Private Limited ("Jhatfat"), and these terms of use ("Terms of Use") govern how users or visitors (the "Users") access it.

Users may use the Platform to access Jhatfat Services (defined below) through either merchants registered with the Platform (referred to as "Tied-up Merchants") or merchants who are not registered with the Platform (referred to as "Non-tied up Merchants"; both Tied-up Merchants and Non-tied up Merchants shall hereinafter be collectively referred to as "Merchants," wherever the context so requires or permits), and delivery partners (referred to as "Delivery Partners").

Before using the platform, signing up for an account there, or accessing any content or information through the platform, users are urged to carefully read the Terms of Use. Users accept these Terms of Use and agree to be bound by them by either continuing to use the Platform or accepting them when they create an account.

Users are given access to and use of the Platform on the condition that they agree to all of the terms, conditions, and notices set forth in these Terms of Use and Privacy Policy, as well as any updates made by Jhatfat in its sole discretion and posted on the Platform from time to time. Subject to the foregoing, Jhatfat grants Users a limited, non-exclusive, and personal right to access and use the Platform and the Jhatfat Services.

1. ELIGIBILITY

a) User represent and warrant that they are at least eighteen (18) years of age or above and are fully able and competent to understand and agree the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms.

b) Compliance with Laws. User are in compliance with all laws and regulations in the country in which you live when you access and use the Services. User agree to use the Services only in compliance with these Terms and applicable law, and in a manner that does not violate our legal rights or those of any third party(ies).

c) Jhatfat reserves the right to deny new Users access to the Platform at any time, as well as to revoke or suspend access for current Users at any time, with or without cause.

d) Users are only allowed to have one active Account on the Platform (as specified below). Furthermore, Users are not allowed to impersonate anybody else in order to register for an account with the Platform or sell, trade, or otherwise transfer their account to another party.

2. REGISTRATION

a) Users are given a specific, non-exclusive, non-transferable, and limited right to access the Platform, utilise the Jhatfat Services, and communicate with Jhatfat, subject to the acceptance of all the terms, conditions, and notices contained in these Terms of Use and Privacy Policy, as well as any amendments made by Jhatfat at its sole discretion and posted on the Platform from time to time. The Platform and Jhatfat Services must be kept up-to-date in order for a User to continue using them.

b) Users must register on the platform, create an account with a special user identity and password (an "Account"), and then log in to utilise the Platform and access the Jhatfat Services. When registering an account, users must provide personal information including their name, contact information, email address, and a working phone number. Users may be required to complete a verification step as part of the registration process in order to validate the information they have provided.

c) Users acknowledge and agree that the data they entered when setting up their accounts is complete, truthful, accurate, and current. Users must immediately update their account information in the event that any of this information changes. Users understand and agree that Jhatfat has not independently verified the information, and Jhatfat is not responsible or accountable in any manner for the truthfulness or completeness of any information provided by Users. Jhatfat reserves the right to suspend or terminate a User Account and deny any and all current or future use of the Platform (or any portion thereof) through such User Account if Users provide any information that is untrue, inaccurate, not current, or incomplete, or if Jhatfat has reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete.

d) Users are entirely accountable for all activities performed using their Account and are responsible for maintaining the confidentiality of the Account details. Users acknowledge and agree to immediately alert Jhatfat of any unauthorised use of their Account, any connected information, or any other security violation, and ensure that they log out from their Account at the conclusion of each session. If User fails to abide by this clause, Jhatfat cannot and won't be held responsible for any loss or harm that results. Users who fail to maintain the security and confidentiality of their Account information risk having their accounts used without their permission, causing losses to Jhatfat or any other User of the Platform or visitor to the Platform. It is expressly forbidden to use another User's account details.

e) When a user uses a computer or a mobile device to request Jhatfat service on the Platform, Jhatfat will use the location-based data that Jhatfat has obtained from the Global Positioning System. Jhatfat shall only use such location-based data to support and enhance the Jhatfat Services provided to Users.

f) The Account shall be permanently suspended in the event that the Platform is unable to verify the User's unique identity against a legitimate cellphone number or email address. In the aforementioned scenario, Jhatfat fully reserves the right to suspend a User's Account and is under no duty or liability to provide any account information.

3. JHATFAT SERVICES

a. The following services are offered to Users by the Platform (collectively, the " Jhatfat Services").

i. It enables Users to connect with Merchants and Delivery Partners in order to view and buy products listed on the Platform by Tied Up Merchants ("Items"), and then permits Users to have the purchased Items delivered by Delivery Partners ("Purchase Services");

ii. It enables Users to have packages picked up and delivered from one location to another through Delivery Partners ("PND Services");

ii. It enables Users to purchase products from Non-tied up Merchants and have those delivered through the Delivery Partners ("Delivery Services").

b. Any of the aforementioned Jhatfat Services may be added, modified, upgraded, extended, or withdrawn at any moment and at Jhatfat's sole discretion. The availability of the Jhatfat Services to Users at all times is not guaranteed by Jhatfat.

c. By signing this agreement, Users accept and recognise that Jhatfat is simply a marketplace and that it only serves as a conduit for transactions between Users, Merchants, and/or Delivery Partners (as applicable). Users hereby acknowledge and agree that Jhatfat is not a party to any transactions that are initiated between Users, Merchants, and/or Delivery Partners through the Platform. Users further agree and acknowledge that Jhatfat shall not be held responsible for any items, services, or products offered and/or delivered by the Merchants or the Delivery Partners, as applicable, and will not be held liable in any other way. In addition, Users hereby agree and acknowledge that Jhatfat shall not be responsible for the behaviour, acts, and/or omissions of the Merchants (including their employees and consultants) and Delivery Partners while providing their items, services, and products to Users, or for any loss or damage to Users resulting from or related to the items, services, and/or products being provided by the Merchants and/or the Delivery Partners, as the case may be.

d) Users agree that Jhatfat is not responsible for any damages of any kind, including but not limited to direct, indirect, incidental, punitive, special, exemplary, or consequential damages, resulting from their use of the Jhatfat Services.

e) Users agree to provide as much information as possible on the Platform with regard to the Items or Jhatfat Services sought to be purchased or accessed on the Platform, as required by Jhatfat or by applicable law. Jhatfat shall have the right to refuse User requests for any Jhatfat Service at any time and without providing a reason; provided, however, that Jhatfat shall use reasonable efforts to notify Users of such cancellations and the reasons behind when appropriate.

f) By signing this agreement, Users acknowledge that Jhatfat is not responsible for the behaviour or activities of the Delivery Partner with regard to any transactions started on the Platform. Additionally, Users acknowledge that Jhatfat has no control over the goods offered by the merchants and that Jhatfat will not be held liable for such goods.

g) The products and services displayed on the platform depend on the merchants' and delivery partners' availability at the time of the transaction.

h) According to applicable law, Jhatfat ‘s Policies (described below), or in Jhatfat ‘s sole discretion, the company will not provide any Jhatfat Services that could lead to any act that is immoral, unethical, illegal, or prohibited. Additionally, Jhatfat has the right to refuse to carry out any task on the grounds that it is against the terms of any agreement to which Jhatfat is a party.

i) Users are aware of and agree that Jhatfat does not sell or provide any Items on its own. The items' quality, merchantability, or fitness is not Jhatfat ‘s responsibility. Therefore, if you have any complaints about a transaction you initiated on the Platform to buy or sell a product from a Merchant, you can contact Jhatfat support to have your complaints forwarded to the Merchant via the Platform.

j) Users must notify Jhatfat of any complaints regarding any of the services within 24 (twenty four) hours of utilizing them.

k) Jhatfat Services cannot be initiated for item(s) which are illegal, hazardous, dangerous, or otherwise restricted or constitute items which are prohibited by any statute or law or regulation. Such items include, but are not limited to, radio-active, incendiary, corrosive or flammable substances, hazardous chemicals, explosives, firearms or parts thereof and ammunition, firecrackers, cyanides, precipitates, gold and silver ore, bullion, precious metals and stones, jewelry, semi-precious stones including commercial carbons or industrial diamonds, currency (paper or coin) of any nationality, securities (including stocks and bonds, share certificates and blank signed share transfer forms), coupons, stamps, negotiable instruments in bearer form, cashier's cheques, travelers’ cheques, money orders, passports, credit/debit/ATM cards, antiques, works of art, lottery tickets and gambling devices, livestock, fish, insects, animals, plants and plant material, human corpses, organs or body parts, blood, urine and other liquid diagnostic specimens, hazardous or bio-medical waste, wet ice, pornographic materials, contraband, bottled alcoholic beverages (except as specifically provided) or any intoxicant or narcotics and psychotropic substances.

4. PAYMENT TERMS

a.Users must pay the price listed on the platform for the Jhatfat Services they use. A supplemental service fee ("Service Fees") may be assessed to users. You must pay the Service Fees before using any of the corresponding Jhatfat Services.

b.Users consent to Jhatfat using specific third-party vendors and service providers, such as payment gateways, to handle the processing of their platform payments.

c. Users may use "Cash on Delivery" to pay for specific Jhatfat Services when the relevant Merchant makes it possible. Users recognise and understand that Delivery Partners might not have exact change when payment is made; as a result, it is the Users' obligation to make sure they pay the precise amount for the Jhatfat Services as specified on the Platform.

5. USER GENERATED CONTENT

a. Users acknowledge and agree that (i) the Platform will prompt them to rate and/or comment on the Delivery Partner (with regard to the services provided by the Delivery Partner) and Merchants (with regard to the Items sold/provided by them) after the completion of a transaction (the "User Content"); and (ii) the Delivery Partner and the Tied-Up Merchants may also be prompted to rate the User on the Platform. The Platform will calculate and show User rating scores based on these ratings of Delivery Partners and Merchants.

b. Users hereby agree that Jhatfat and its affiliates may use, disseminate, and display User Content in any way in connection with the operations of Jhatfat and its affiliates, including on the Platform, without giving credit to or approval from Users. If User Content contains obscenities or other objectionable material, contains a person's name or other personal information, or otherwise violates any privacy laws, other applicable laws, or Jhatfat's Policies or the content policies of its affiliates, Jhatfat and its affiliates reserve the right to edit or remove the User Content.

6. CANCELLATION AND REFUND

a. Upon receiving a confirmation from Users for a transaction they have initiated, Jhatfat will confirm and begin the execution of that transaction. Users must choose the cancel option on the platform if they want to end a transaction there. It should be reminded that Users may be required to pay a cancellation charge for transactions started on the Platform for which the Delivery Partner or the Merchant, depending on the situation, has already started working on the transaction. The cancellation fee will be assessed to such Users with regard to the work that Merchants have already started, in accordance with their cancellation and refund policies.

b. Jhatfat may cancel transactions initiated by Users on the Platform, on the instructions of the Merchants/Delivery Partners, if:

i) The designated address provided by Users is outside the service zone of the Merchant/Delivery Partner.

ii) There is no User response via phone or any other communication channel at the time of confirmation of the order booking.

iii) The transaction involves supply/delivery/purchase of any material good that is illegal, offensive or violative of the Terms of Use.

iv) The User is not physically present or is unreachable once the Delivery Partner reaches the designated delivery location, for a period in excess of fifteen (15) minutes.

v) Information, instructions and authorizations provided by Users are not complete or sufficient to execute the transaction.

vi) If any Merchant’s outlet is closed.

vii) If a Delivery Partner is not available to perform the services.

viii) If any Item or product is not in stock with the Merchant.

ix) If the transaction cannot be completed for reasons not in control of Jhatfat.

c. Users may only request refunds for transactions that have already started if they have already paid the associated fees. Users shall be qualified for the return on the following conditions, subject to the applicable Merchant's refund policy and in compliance therewith:

i) Based on criteria set by Jhatfat in its sole discretion, Jhatfat has determined that the shipment was tampered with or damaged at the time of delivery.

ii) If the incorrect item—one that does not correspond with the one for which the users had started a transaction on the platform—has been delivered to users, provided, however, that the user has not already been informed of the change in the item,

iii) Jhatfat has cancelled the order because of any reason mentioned under Clause 6.2.6, Clause 6.2.7, Clause 6.2.8 or Clause 6.2.9. above.

d. All refund-related decisions will be made solely at Jhatfat’s discretion and in accordance with Jhatfat’s internal refund policy; these decisions will be final and binding. Every refund that Jhatfat starts will go back to the account that the user used to start the Platform transaction with.

e. All refund amount shall be credited to Buyer’s account or wallet within estimated timelines of 5-9 business days.

7. Representations and Warranties

a. Subject to compliance with the Terms of Use, Jhatfat grants Users a non-exclusive, limited privilege to access and use this Platform and the Jhatfat Services.

b. Users agree to use the Platform only: (i) for purposes that are permitted by this Terms of Use; and (ii) in accordance with any applicable law, regulation, or generally accepted practices or guidelines. Users agree not to engage in activities that may adversely affect the use of the Platform by Jhatfat or Delivery Partner(s) or Merchants or other Users.

c. Users represent and warrant that they are legally entitled to view and access the Platform and use the Jhatfat Services. Users represent and warrant that they are not prohibited from accessing the Platform by any notice from a third party or governmental agency or by any litigation that is currently pending against them in any court of law.

d) Users represent and warrant that they are not prohibited from using the Platform by any notice from a third party or governmental authority.

e. Users consent to not using any other method than the Jhatfat-provided interface to access (or attempt to access) the Platform. Users may not reproduce or attempt to reproduce the navigational structure or presentation of the Platform, materials, or any Jhatfat Property, or use any deep links, robots, spiders, or other automatic devices, programs, algorithms, or methodologies, or any similar or equivalent manual process, to access, acquire, copy, or monitor any portion of the Platform or to obtain or attempt to obtain any materials, documents, or information through any means not specifically made available.

f. Users recognize and accept that they may be exposed to content from others that they may find offensive, obscene, or otherwise objectionable by accessing or using the Platform. Jhatfat disclaims all responsibility for any liabilities resulting from any objectionable content on the Platform.

g. Additionally, Users agree not to:

Users acknowledge and agree that they use the Jhatfat Services at their own risk and that Jhatfat expressly disclaims all representations and warranties, express or implied, regarding condition, suitability, quality, merchantability, and fitness for any purpose. This exclusion is made to the fullest extent permitted by law.

i. Without prejudice to the above, Jhatfat makes no representation or warranty that the Jhatfat Services will meet the Users' requirements.

j. All materials/content on the Platform (except any third-party content available on the Platform), including, without limitation, names, logos, trademarks, images, text, columns, graphics, videos, photographs, illustrations, artwork, software, and other elements (collectively, “Material”) are protected by copyrights, trademarks, and/or other intellectual property rights owned and controlled by Jhatfat. Users acknowledge and agree that the Material is made available for limited, non-commercial, personal use only. Except as specifically provided herein or elsewhere in our Platform, no Material may be copied, reproduced, republished, sold, downloaded, posted, transmitted, or distributed in any way, or otherwise used for any purpose other than the purposes stated under this Terms of Use, by any person or entity, without Jhatfat’s prior express written permission. Users may not add, delete, distort, or otherwise modify the Material. Any unauthorized attempt to modify any Material, to defeat or circumvent any security features, or to utilize our Platform or any part of the Material for any purpose other than its intended purposes is strictly prohibited. Subject to the above restrictions under this Clause, Jhatfat hereby grants Users a non-exclusive, freely revocable (upon notice from Jhatfat), non-transferable access to view the Material on the Platform.

8. Intellectual Property Rights

a. Jhatfat ("Jhatfat Property") owns the Platform and its operation, as well as the choice and arrangement of all content on it, with the exception of any third-party software made available on the Platform, including but not limited to all text, videos, graphics, user interfaces, visual interfaces, sounds and music (if any), artwork, algorithms, and computer code (and any combination thereof). Without Jhatfat's prior written approval, users are not entitled to use its property.

b. Except for any trademarks, logos, and service marks of third parties that may be found on the Platform, all trademarks, logos, and service marks shown on the Platform (the "Marks") are the property of Jhatfat. Users are not allowed to use the Marks without first receiving permission from Jhatfat or the appropriate third party.

c. Any user who thinks the Platform violates their intellectual property must send a legal notice to Jhatfat at fatjhat@gmail.com right away. Only the intellectual property owner or an agent duly authorized to act on their behalf should submit these notifications. However, if a User makes a false claim, their access to the Platform may be terminated. Users must include the following information in their notice:

  1. The intellectual property they believe is being violated;
  2. The item they believe is violative and must include enough information to pinpoint its location on the Platform;
  3. A statement that they have a good faith belief that the item they have identified as violative is not permitted by the intellectual property owner, its agent, or the law to be used.
  4. The User's physical or electronic signature;
  5. The User's contact information, such as the User's address, phone number, and/or email;
  6. A declaration that the details provided in the User's notice are accurate;
  7. A statement that the User is the intellectual property owner or an agent authorized to act on behalf of the intellectual property owner whose intellectual property is being infringed;

10. Indemnification and Limitation of Liability

a. Users agree to hold Jhatfat and its affiliates, including but not limited to its officers, directors, consultants, agents, and employees ("Indemnitees"), harmless from and against any and all losses, liabilities, claims, damages, demands, costs, and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by the Indemnitees that arise out of, are related to, or may be paid by Users. Additionally, Users agree to indemnify the Indemnitees from any liability resulting from, arising from, or connected with, such Users' use of the Platform, Jhatfat Services, any misrepresentation with regard to the data or information provided by Users in relation to their Account, Users' violation of the Terms of Use, or Users' violation of any third-party rights, including any intellectual property rights.

b. Any special, incidental, indirect, consequential, or punitive damages of any kind resulting from or related to Users' use of or access to the Platform or Jhatfat Services on the Platform are expressly disclaimed by the Indemnitees.

c. The User's indemnification duty under the Terms of Use will continue even after they stop using the Platform or Jhatfat Services or cancel their Account.

d. In no circumstances shall Jhatfat or its employees' total liability resulting from or connected with the Jhatfat Services or the use of the Platform exceed INR 100 for any and all causes of action brought by Users or on behalf of Users, subject to applicable laws.

e. Only Users residing in India have access to the Platform and the Jhatfat Services. Users are not permitted to access or utilize the Platform outside of India. Users are responsible for adhering to all applicable laws if they access or use the Platform from a country other than India, and Jhatfat is in no way responsible for this.

12. Violation of the Terms of Use

Users agree that any violation of these Terms of Use by Users will be illegal and unfair business practice, as applicable, and will result in irreparable harm to Jhatfat for which monetary damages would be insufficient. Users agree that Jhatfat is entitled to seek any injunctive or equitable relief they deem necessary or appropriate in such situations. Jhatfat may also have further legal or equitable options in addition to these remedies. Users agree to pay any reasonable legal fees and costs associated with any legal action taken by Jhatfat against them as a result of their breach of these Terms of Use, as well as any other damages that Jhatfat may be awarded.

13. Link to third parties

There may be links on the Platform to third-party websites (i.e. advertisers, affiliate partners, strategic partners, or others). The products or services offered by any of these companies or people, as well as the accuracy of the information on such third-party websites, are not guaranteed by Jhatfat, and Jhatfat shall not be liable for inspecting or evaluating such third-party websites. Jhatfat disclaims all duty and responsibility for the conduct, output, and content of any such third-party websites. Users should study the relevant terms of use and policies for such third-party websites before using or gaining access to any such third-party websites. Users do so at their own risk if they choose to access any such connected third-party website.

14. Additional Terms

In addition, in order for Users to participate in particular campaigns or activities made available through the Platform, Jhatfat may place extra conditions on them (the "Policies"). Users agree to adhere by these Policies, which will be a part of these Terms of Use, when they participate in such campaigns or otherwise carry out activities covered by those extra terms.

15. Term and Termination

a. The User or Jhatfat may terminate these Terms of Use at any time for any reason as described below.

b. The User may i) close their Account through the Platform or (ii) cease accessing the Platform if they disagree with the Terms of Use or are unhappy with the Platform or Jhatfat Services.

c. Jhatfat reserves the right, at any time and for any reason, to prevent any User from using the Platform or the Jhatfat Services. These Users shall be accountable for all unpaid balances related to the Merchant Services even after a Jhatfat Account is disabled, turned dormant, or inactive.

d. If Jhatfat determines, in its sole and absolute discretion, that a User has violated, breached, violated, abused, or unethically manipulated or exploited any term of these Terms of Use or has otherwise acted unethically, Jhatfat may delist that User, block their future access to the Platform, suspend or terminate their Account, or any combination of these actions.

e. Regardless of anything else in this section, these Terms of Use are perpetual unless and until Jhatfat decides to terminate them.

f. Users also acknowledge and agree that Jhatfat shall have the right to retain all information relating to the transactions that Users initiated on the Platform after termination.

16. Governing Law

Without regard to conflict of law considerations, Indian law shall govern the interpretation and construction of these Terms of Use, and any disputes arising out of or relating to them shall be exclusively subject to the jurisdiction of the courts, tribunals, fora, and relevant authorities in Dehradun.

17. Report Abuse

Users can report abuse, violations of these Terms of Use, and objectionable content on the Platform to the following email address: fatjhat@gmail.com. If Users have any questions about these Terms of Use or the Jhatfat Services, they should send an email to fatjhat@gmail.com

18. Communications

a. The User hereby expressly consents to receiving communications from Jhatfat or other third parties via SMS, email, and/or WhatsApp. The User may unsubscribe from or opt out of receiving communications via SMS, WhatsApp, and email at any time by using the relevant communication channels or by getting in touch with customer support; provided, however, that Users may still receive communications relating to their use of the Jhatfat Service.

19. General

a. Amendments: Without any need to do so, Jhatfat reserves the unrestricted right to change or amend these Terms of Use, Privacy Policy, and Policies. Users can look at the "Last Updated" legend above to find out when these Terms of Use were most recently updated. The User shall be responsible for regularly reviewing these Terms of Use, Privacy Policy, and Policies for updates. The User agrees to be bound by the updated Terms of Use and accepts such changes by accepting the modified Terms of Use or by continuing to use the Platform.

b. Notice: The User's registered email address will get all messages from Jhatfat, in addition to any general announcements made on the Platform.

c. Assignment: The Terms of Use and any rights granted hereby cannot be assigned or otherwise transferred by Users to any other party. Jhatfat may freely assign its rights under the Terms of Use to any third party without the need to notify or get the User's permission.

d. Severability: The remainder of the Terms of Use shall remain in full force and effect in the event that a court of competent jurisdiction rules that any provision of the Terms of Use, or any portion thereof, is invalid for any reason, and such invalidity shall not affect the enforceability of any other provision or portion of the Terms of Use.

e. Waiver: Jhatfat will not be deemed to have waived any Terms of Use provision or related right by failing to enforce or implement that provision or right.

f. Integration: These Terms of Use, along with Jhatfat’s Privacy Policy and Policies, any other legal notices, communications posted by Jhatfat on its Platform, and any other agreements signed by the User and Jhatfat, govern the User's use of the Platform and Jhatfat Services and supersede any prior agreements between the User and Jhatfat with regard to the Platform and Jhatfat services.

Purchase Services Policy

1. General Terms and Conditions

a. These terms and conditions specifically apply to the Purchase Services, despite the Terms of Use's wide applicability.

b. For Purchase Services, it is the Tied-Up Merchants' responsibility to post an updated item list with prices on the platform. For any incorrectly listed item on the Platform, Jhatfat disclaims any liability. Additionally, Users accept and recognize that it may not be practicable for the Tied-up Merchants to display the precise price or pricing of some Items (especially those that are perishable in nature) on the Platform.

2. Medicine Purchase

a. Users who use the Platform to purchase any medications or pharmaceutical products requiring a valid prescription from a licensed medical professional must upload the relevant prescription. In order to avoid Jhatfat terminating the Purchase Service and taking necessary action against the User at its sole discretion, it is the User's responsibility to make sure that a clear copy of the valid prescription is submitted when starting the transaction.

4. Tobacco Purchase

a. Jhatfat makes it easier for Tied-Up Merchants to list and sell tobacco and tobacco products, and for Delivery Partners to transport those products to Users who are over the legal drinking age of eighteen (18) or a higher age as may be required by the relevant law. This means that before making a purchase, the User agrees to go through and finish the Platform's required age verification process by providing the required documentation. Users agree to submit legitimate, legible documentation for verification; if they fail to do so, they will not be permitted to access the Platform to buy tobacco goods. The accuracy of the papers that users provide will be their entire responsibility. In this regard, Jhatfat disclaims any liability.

b. Users might additionally need to show proper identification as evidence of age while receiving their order. In the event that the proper documentation is not presented at the time of delivery, Jhatfat reserves the right to unilaterally terminate the Purchase Service and end the transaction without issuing a refund to the User.

c. Users must make sure that no Purchase Services are ordered for delivery at or within a predetermined distance (as specified by applicable law) from public places, such as schools, churches, and other houses of worship, as well as hospitals and other healthcare facilities;

5. Payment Terms

Users are required to pay the price of the Items up in advance when starting a request for a Purchase Service. Once the money has been made, the transaction for the Purchase Service will be started on the Platform. The Delivery Partner upon arriving at the Merchant outlet shall inform User about the Item price and User shall be required to confirm the purchase of the Item and make the payment for the same to complete the transaction. In some exceptional circumstances, where the purchase price of the Item is not available on the Platform or Items that are perishable in nature or Item whose price varies periodically or where the User is offered an alternative Item when the original Item is not in stock.

Delivery Services Policy

Despite the Terms of Use's generality, these terms and conditions only apply to the Delivery Services and should be read in accordance with them.

1. Delivery Services

a. The PND Services enable Users to establish connections with Delivery Partners and Non-tied up Merchants in order to complete tasks submitted by such Users, such as those involving the purchase, pick up, and delivery of items (referred to as "User Items") from Non-tied up Merchant locations ("Pick-Up Location") and their drop-off at alternative locations ("Drop Location"). It is expressly stated that Jhatfat does not take any duty or liability for any kind of service shortcoming on the part of the Non-tied up Merchants or the Delivery Partner and just serves as a technology platform to facilitate Delivery Tasks launched on the Platform.

b. As soon as a request for a delivery task is made, a delivery partner is allocated to it depending on their availability and acceptance. The User Item Picture/(s) and the associated value on the Platform must be sent by the Delivery Partner for User Confirmation along with images of the User Items that are listed on the Platform ("User Item Picture/(s)"). Users are advised to carefully examine and validate the User Item Pictures before starting a payment. If a dispute arises between a User and the Delivery Partner, the Jhatfat will rely on the User Confirmation of the User Item Pictures. Users should immediately contact the designated Delivery Partner and ask them to share the proper User Item Picture/(s) if the User Item Picture/(s) differs from the User Item stated on the Platform (s). User approval of a User Item picture is interpreted as acceptance of the amended or new User Item.

2. In using the Delivery Services, the Users understand, agree, acknowledge and accept that:

a. The participation of the Delivery Partners with Jhatfat is principle to principal, non-exclusive, and voluntary. There is no employer-employee connection between Jhatfat and the Delivery Partners, nor does Jhatfat have any influence over them.

b. A Delivery Partner's acceptance of a Delivery Task will result in a separate service agreement between them.

c. If the Delivery Partners fail to complete a Delivery Task or violate one, Jhatfat is not liable. Jhatfat makes no promises regarding the accomplishment of any Delivery Tasks started on the Platform by Users or Delivery Partners, respectively.

d. Jhatfat is not a retail establishment, restaurant, food delivery service, product delivery service, shipping or courier service, or company that prepares food. Jhatfat runs an online marketplace, but at no stage during any transaction does it have any ownership or any rights to the goods being delivered as part of any Delivery Task.

e. The User has voluntarily added the Pick-Up Location and the Drop Location to the Platform, and the Location Data of the User is collected in accordance with the Terms of Use and Privacy Policy.

f. Users are aware of the items that will be transported through a delivery task and that delivery tasks cannot be started for item(s) that are forbidden by any statute, law, or regulation, dangerous, hazardous, or otherwise restricted. Such items include, but are not limited to, radio-active, incendiary, corrosive or flammable substances, hazardous chemicals, explosives, firearms or parts thereof and ammunition, firecrackers, cyanides, precipitates, gold and silver ore, bullion, precious metals and stones, jewelry, semi-precious stones including commercial carbons or industrial diamonds, currency (paper or coin) of any nationality, securities (including stocks and bonds, share certificates and blank signed share transfer forms), coupons, stamps, negotiable instruments in bearer form, cashier's cheques, travelers’ cheques, money orders, passports, credit/debit/ATM cards, antiques, works of art, lottery tickets and gambling devices, livestock, fish, insects, animals, plants and plant material, human corpses, organs or body parts, blood, urine and other liquid diagnostic specimens, hazardous or bio-medical waste, wet ice, pornographic materials, contraband, bottled alcoholic beverages or any intoxicant or narcotics and psychotropic substances. Jhatfat does not deliver alcohol or drugs.

g. Delivery Tasks cannot be created for the delivery of any goods that, in accordance with the legislation, require a particular transportation license or authorization.

h. Delivery Partners may inform law enforcement authorities of any offenses committed during a delivery task or their plans to do so if they become aware of them.

i. When the Delivery Partner arrives at the Non-tied up Merchant outlet, they will inform the Users of the price of the User Items and ask them to confirm the purchase. Users must pay for the same in order to finish the transaction.

3. Payments

Users must pay the purchase price of their User Items through the Platform in order to use the Delivery Service, as may be specified by the Delivery Partner on behalf of the Non-Tied up Merchant. The Delivery Partner may only buy the User Items and complete the Delivery Service after processing the agreed-upon sum via the Platform.

4. Cancellations

When a delivery task has been confirmed on the platform, it cannot be canceled. A cancellation fee will apply if you cancel after receiving confirmation, as stated to you on the platform.

Pick Up and Drop Off Terms

1. PND Services :

a. The PND Services enable Users to establish connections with Delivery Partners and complete tasks submitted by such Users, such as picking up and dropping off items (referred to as "User Items") from one location (referred to as the "Pick-Up Location") and dropping them off at another location (referred to as the "Drop Location"). It is expressly stated that Jhatfat does not take any duty or liability for any type of delivery partner service inadequacy and just serves as a technological platform to support PND Tasks launched on the Platform.

b. Upon submitting a request for a PND Job, a Delivery Partner will be allocated to that task based on their availability and acceptance. The User Items must be picked up at the Pick-Up Location by the Delivery Partner and dropped off at the Drop Location.

2. In using the PND Services, the Users understand, agree, acknowledge and accept that:

a. The Delivery Partners’ engagement with Jhatfat is on a principal to principal, non-exclusive and voluntary basis. No control is exercised by Jhatfat on the Delivery Partners and there is no employer-employee relationship between Jhatfat and the Delivery Partners.

b. A Delivery Partner's acceptance of a PND Task will result in an independent service contract between Users and the Delivery Partner.

c. Any non-performance or violation of any PND Task by the Delivery Partners is not the responsibility of Jhatfat. Jhatfat makes no promises regarding the accomplishment of any PND Tasks started on the Platform by Users or Delivery Partners, respectively.

d. Jhatfat is not a retail establishment, restaurant, food delivery service, product delivery service, shipping or courier service, or company that prepares food. Jhatfat runs an online marketplace but does not have any ownership or other rights to the goods being carried as part of any PND Task at any stage during any transaction.

e. The User has willingly uploaded the Pick-Up Location and the Drop Location to the Platform, and the Location Data of the User is gathered in compliance with the Terms of Use and Privacy Policy.

f. They are aware of the items to be transported through a PND Task, and that PND Tasks cannot be initiated, for item(s) which are illegal, hazardous, dangerous, or otherwise restricted or constitute items which are prohibited by any statute or law or regulation. Such items include, but are not limited to, radio-active, incendiary, corrosive or flammable substances, hazardous chemicals, explosives, firearms or parts thereof and ammunition, firecrackers, cyanides, precipitates, gold and silver ore, bullion, precious metals and stones, jewelry, semi-precious stones including commercial carbons or industrial diamonds, currency (paper or coin) of any nationality, securities (including stocks and bonds, share certificates and blank signed share transfer forms), coupons, stamps, negotiable instruments in bearer form, cashier's cheques, travellers’ cheques, money orders, passports, credit/debit/ATM cards, antiques, works of art, lottery tickets and gambling devices, livestock, fish, insects, animals, plants and plant material, human corpses, organs or body parts, blood, urine and other liquid diagnostic specimens, hazardous or bio-medical waste, wet ice, pornographic materials, contraband, bottled alcoholic beverages or any intoxicant or narcotics and psychotropic substances. g. PND Tasks cannot be created to dispatch any item(s) that are legally required to have a special transportation permit or special license.

h. Delivery Partners may inform law enforcement authorities of any offences committed during a PND Task or their intentions to do so as soon as they become aware of them.

3. Payments

Prior to starting a PND Task, Users are required to pay the applicable service fees that are listed on the Platform. The Delivery Partner won't start or finish the PND Task until the service charge has been successfully received.

4. Cancellation

PND tasks cannot be canceled once they have been confirmed on the platform. A cancellation fee will apply if you cancel after receiving confirmation, as stated to you on the platform.

Jhatfat Wallet - Terms and Conditions

For Jhatfat wallet ("Jhatfat Wallet"), the terms and conditions listed below apply. These terms are in addition to the Terms of Use and will be reviewed with them.

1. Jhatfat wallet is a type of redemption point that is awarded to Users on the Platform by Jhatfat at the time of Account creation, through referrals (the "Referral programme"), or in any other way that Jhatfat may choose to specify.

2. Users will be informed on the Platform about any changes to the quantity of Jhatfat coins in the wallet issued, the maximum amount that can be used per order, and the validity of Jhatfat Wallet.

3. Jhatfat wallet cannot be withdrawn, exchanged for real money, or given to another user in any way.

4. Users may only utilize Jhatfat wallet for their own personal needs. You cannot use Jhatfat wallet for commercial or corporate endeavors. It is strictly forbidden to use Jhatfat wallet for personal gain, and doing so will result in suspension or termination from using Jhatfat wallet and the Platform.

5. According to the autonomous judgment of Jhatfat, Jhatfat wallet might not be applicable for some Jhatfat Services and in some geos.

6. There is no way to combine Jhatfat wallet with any other discount or promotion running on the Platform.

7. The independent decision made by Jhatfat shall be final and binding in any dispute involving the amount of Jhatfat Cash, its use, etc. Additionally, Jhatfat has the right to suspend a User following an investigation if it has cause to think that the User acted dishonestly in order to get Jhatfat wallet or in using Jhatfat wallet in a manner that is against this Policy. Additionally, the User will not be permitted to utilize any of their available Jhatfat wallet while an inquiry is ongoing.

Jhatfat Referral Programme

1. The goal of the Jhatfat referral programme is to incentivize eligible Users to recommend the Platform to their contacts.

2. Each eligible User (a "Referee") is given a referral code, which they can choose to give to individuals they know personally and who have agreed to receive it.

3. Upon entering the referral code provided by the Referee when creating an Account, each new User (a "Referred User") will receive Jhatfat Cash in their wallet.

4. Within the first 7 (seven) days of the Referred User creating an Account, the Referee will receive Jhatfat Cash if the Referred User uses the Platform for a task worth at least INR 100/- (Indian Rupees One Hundred only).

5. A Referee may refer a total of ten (10) Referred Users.

6. Only those they know personally and who have agreed to receive the referral code may be referred to and given the referral code by referees. The referral code may not be shared in mass or through spam email campaigns, nor may users publish it on any open forum for distribution to strangers. Any breach of these rules will result in an automatic ban from using the platform.

7. The referral code will expire once a Referee has received the maximum number of referrals.

9. Referees are prohibited from using Jhatfat to self-refer or to open up multiple, fictitious, or false accounts. Referees and their Referred Users are also prohibited from using Jhatfat Cash in the following ways: (i) to break the law, infringe on the rights of others, or act in a way that is unfair, disruptive, harassing, harmful, or illegal; (ii) to gather or harvest any personally identifiable information from the referral programme; and (iii) to use any system, bot, or other device to participate in the referral programme or to benefit from it in any way. Without providing users with prior warning, Jhatfat has the right to end the Referral Program or change these conditions at any moment.
